Arizona Telehealth Registration and Your Statutory Agent

Arizona opened its patients to out-of-state clinicians through A.R.S. § 36-3606, the interstate telehealth statute. A provider licensed in another state can deliver telehealth to someone located in Arizona without a full Arizona license, but only after registering with the Arizona regulatory board for that profession. Every registration also has to name an Arizona statutory agent who can accept legal process on the provider's behalf.

Contents of the Application
Each board writes its own form, but the statute fixes what it must capture: the provider's name; proof of licensure listing every U.S. jurisdiction and license number (the board verifies through the licensing board's website); the provider's address, email and telephone number, including a way to reach the provider urgently; evidence of professional liability insurance; and the name of the Arizona statutory agent.

- A response to an emergency medical condition
- A consultation with an Arizona-licensed provider who keeps ultimate authority over the patient's diagnosis and treatment
- After-care specifically related to a procedure delivered in person in another state
- Care for a resident of another state by that person's primary care or behavioral health provider in the person's home state
So is a provider whose Arizona telehealth volume stays under ten encounters per calendar year.
Limits on a Registered Provider
- No Arizona office, unless the office belongs to a multistate group with one or more Arizona-licensed providers
- No in-person care for patients in Arizona without first obtaining an Arizona license
- Arizona standards apply: scope of practice, prescribing rules, telehealth requirements, the best practice guidelines adopted under § 36-3607, and Arizona's standard of care for the profession
- Arizona jurisdiction: registering is consent to Arizona's jurisdiction for discipline and legal proceedings tied to the care, and venue for an action over a violation lies in the patient's county of residence
- Five-day notice to the board of any new restriction on the provider's license or any disciplinary action initiated or imposed
A board that finds a violation can revoke or prohibit the provider's Arizona privileges, report it to the national practitioner data bank and refer it to the provider's home licensing board.
The Statutory Agent's Role
Because a registered provider has no Arizona office, the statutory agent named on the registration is where Arizona process lands: a summons in a malpractice case filed in the patient's county, a board's notice, a subpoena. The agent's job is to accept delivery and get it to you while there is still time to respond.

Is my practice entity covered by my telehealth registration?
No. Section 36-3606 registers the individual provider. If a company you own does business in Arizona, it registers separately with the Arizona Corporation Commission and names its own statutory agent. See our page on foreign registration.

A count of the Arizona patients seen during the prior year, how many encounters there were and of what type, and a refresh of the registration details.
What happens if I let my agent lapse?
The designation is a required part of the registration, and a provider who fails to comply with Arizona's laws and rules can face investigation and action by the board. Keep the agent current for as long as you hold the registration.
